1. About DentConsentUK

DentConsentUK is a software-as-a-service platform operated by DentConsentUK Ltd ("we", "us", "our"), a company registered in England and Wales. Our platform enables GDC-registered dental professionals to send personalised treatment option information and obtain digital informed consent from patients via a secure patient portal. By registering for or using DentConsentUK, you agree to these Terms of Service ("Terms"). If you do not agree, you must not use the platform.

2. Eligibility

To register for and use DentConsentUK, you must: • Be registered with the General Dental Council (GDC) as a dental professional, or be authorised to act on behalf of a GDC-registered practice • Be at least 18 years old • Have the authority to enter into legally binding contracts • Provide accurate registration information, including a valid GDC number where requested We reserve the right to suspend or terminate any account where eligibility requirements are not met.

3. The Service

DentConsentUK provides: • A dentist-facing dashboard for creating and managing patient consent sessions • A patient portal (DCPP) through which patients review treatment options and provide digital consent • Generation of consent records including FP17PR patient declarations (NHS) and private treatment plans • Delivery of consent records to the practice via email DentConsentUK is a communication and documentation tool. It does not provide clinical advice, diagnosis, or treatment recommendations. The platform assists with the administrative and documentation aspects of the consent process only.

4. Critical disclaimer — clinical responsibility

YOU, AS THE REGISTERED CLINICIAN, REMAIN SOLELY RESPONSIBLE FOR OBTAINING VALID INFORMED CONSENT IN COMPLIANCE WITH GDC STANDARDS. DentConsentUK does not replace your professional judgement or your obligations under: • GDC Standards for the Dental Team (Standards 3.1–3.5) • The Montgomery v Lanarkshire Health Board [2015] UKSC 11 ruling • The Mental Capacity Act 2005 • Any other applicable clinical, legal, or regulatory requirements The treatment descriptions, risks, benefits, and alternative information provided in the platform are templates for general guidance only. You are responsible for ensuring the information provided to each patient is accurate, complete, and appropriate for their specific clinical circumstances. You must not rely solely on pre-populated treatment descriptions without reviewing their accuracy for each patient. DentConsentUK accepts no liability for clinical outcomes, consent disputes, GDC complaints, or any harm arising from your use of the platform.

5. Subscriptions and billing

DentConsentUK is offered on a subscription basis across three plans: Solo, Practice, and Practice Pro. Pricing is as published on our website at the time of subscription. Billing: Subscriptions are billed monthly in advance. All prices are in GBP and inclusive of VAT where applicable. A valid payment method is required to subscribe. Cancellation: You may cancel your subscription at any time from Settings > Subscription. Cancellation takes effect at the end of your current billing period. No refunds are provided for unused portions of a billing period. Price changes: We will provide at least 30 days' notice of any price changes. Continued use after the effective date constitutes acceptance.

6. Acceptable use

You agree not to: • Use DentConsentUK for any purpose other than obtaining dental patient consent • Submit false, misleading, or inaccurate patient information • Attempt to reverse engineer, copy, or reproduce any part of the platform • Use the platform to process data for patients who have not been seen by a GDC-registered professional at your practice • Resell, sublicense, or otherwise transfer access to the platform • Circumvent any security or access controls • Use the platform in any way that violates applicable law, GDC standards, or NHS regulations

7. Patient data and GDPR

DentConsentUK acts as a Data Processor on your behalf in relation to patient personal data. You, as the dental practice or individual dentist, are the Data Controller. You are responsible for: • Having a lawful basis for processing patient data using our platform • Ensuring patients are informed about how their data is used (via your own privacy notice) • Complying with UK GDPR and the Data Protection Act 2018 in your use of the platform • Signing our Data Processing Agreement (DPA), which is incorporated into these Terms We provide a Data Processing Agreement upon request and handle patient data only in accordance with your instructions and our Privacy Policy. Patient consent records are stored in the United Kingdom. Limited personal data may be processed by our sub-processors — such as Twilio (SMS delivery) and Resend (email delivery) — on infrastructure outside the UK, under appropriate safeguards as set out in our Privacy Policy.

8. Data retention

Signed consent records are retained for a minimum of 10 years from the date of creation, in line with GDC guidance on patient record retention for adults (or until the patient's 25th birthday where treatment was provided during childhood). Incomplete or expired consent sessions have patient-identifiable data purged after 30 days. Upon cancellation of your subscription, your consent records remain accessible and exportable for 90 days. After this period, records are archived and may only be retrieved by contacting us directly at hello@dentconsentuk.co.uk.

9. Intellectual property

All content, software, designs, trademarks, and intellectual property in the DentConsentUK platform are owned by DentConsentUK Ltd or licensed to us. Nothing in these Terms grants you any ownership rights in the platform. You retain ownership of all patient data and consent records generated through your use of the platform.

10. Limitation of liability

To the maximum extent permitted by law: • DentConsentUK's total liability to you shall not exceed the total subscription fees paid by you in the 12 months preceding the claim • We are not liable for any indirect, consequential, incidental, or special damages, including loss of revenue, loss of data, or clinical harm • We are not liable for any failure to perform caused by circumstances outside our reasonable control Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

11. Termination

We may suspend or terminate your account immediately if: • You breach these Terms • You use the platform in a way that poses a risk to patients or to the integrity of consent records • You fail to pay subscription fees • We are required to do so by law or regulatory authority Upon termination, your access to the platform ceases. Your consent records remain available for export for 90 days as described in Section 8.

12. Changes to these Terms

We may update these Terms from time to time. Where changes are material, we will provide at least 14 days' notice by email. Continued use of the platform after the effective date constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
